GRAND CHALON – SINGLE PUBLIC INVESTIGATION NOTICE

REGARDING THE FOLLOWING 4 OBJECTS:

1/ Revision of the local inter-municipal urban plan (PLUi) of Grande Chalon;

2 / Cancellation of the communal cards of Aluze, Bouzeron, Chassi-les-Camps and Saint-Gilles;

3/ Modification No. 1 Architecture and Heritage Augmentation Zone (AVAP)

the Fontaine Site of Remarkable Heritage (SPR);

4/ Development of local inter-municipal advertising regulations (RLPi) for Grand Chalon.

Article 1: object

The President of Grand Châlons, by order No. AA-2022-040, ordered the organization of a unified public inquiry in accordance with the Environmental Code, the purpose of which is to ensure public information and participation, as well as taking into account the interests of third parties and relates to the following 4 projects:

– revision of the local inter-municipal urban plan (PLUi) of the 51 member municipalities of Grand Châlons, approved by the Community Council on 11/8/2021;

– the abolition of the communal cards Aluze, Bouzeron, Chassi-le-Camp and Saint-Gilles simultaneously with the entry into force of PLUi;

– Modification No. 1 of the Architectural and Heritage Improvement Area (AVAP) of the SPR de Fontaines, as revised by PLUi;

– development of local inter-municipal advertising regulations (RLPi) of the 51 member municipalities of Grand Châlons, approved by the Community Council on 11.08.2021.

Article 2: Decisions that can be taken at the end of a public inquiry

Draft PLUi and RLPi, possibly modified to reflect the opinions attached to the case, public observations, the report and findings of the Commission of Inquiry, will be submitted for approval by the Grand Chalon Community Council. It will also decide on the cancellation of 4 municipal cards, which will then be ratified by prefectural decree.

Only comments made on the points covered by Fontaine’s Modification No. 1 AVAP will allow for an adjustment of the file to be adopted by the Grand Châlons Community Council after a positive opinion from the Mayor’s Office. “Architect of the buildings of France and consent of M. Prefect.

Article 3. Composition of the commission for public investigation

The Administrative Court of Dijon, by decision of December 9, 2021, appointed a commission of inquiry. It is composed of Mr. Jean-Philippe BOUDET as Chairman of the Commission of Inquiry and Mr. Dominique MONTAGNE and Ms. Catherine SEKCHI as full members.

Article 4. Duration of a single public investigation

The Public Inquiry will run for 31 consecutive days:

from Tuesday, April 5, 2022 at 2:00 pm to Friday, May 6, 2022 at 12:00 am.

Article 5: File consultation

The Public Investigation Headquarters is located at:

Opening hours: Monday to Friday from 9:00 to 12:30 and from 14:00 to 17:30.

Secretaries of the respective 51 municipalities are available to the public for any information and assistance in accessing the public request digital file. Each town hall has an extract from the municipal document from the RLPi and revised PLUi files that the public can consult.

Any person may, at his own request and at his own expense, receive information about the materials of the public investigation by sending a written request to the headquarters of the inquiry.

Article 6: PLUi Environmental Assessment and Project Conclusion

The Grand Chalon PLUi revision project was the subject of an environmental assessment, including a non-technical summary, which is included in the presentation report (Appendix 1-6). The opinion of the environmental authority, the Grand Châlon’s response, and the opinions of the local authorities and their groups are included in the public inquiry file.

The main changes made to Fontaine’s AVAP file were examined as part of the environmental assessment of the revised PLUi project in relation to zoning changes.

RLPi, modification of AVAP and cancellation of municipal cards are not subject to environmental review.

Article 7: Comments and suggestions from the public

Any person may make comments and suggestions during the entire period of the investigation, that is, from Tuesday, April 5, 2022, from 14:00 to Friday, May 6, 2022, at 12:00, in one of the following ways:

in one of the 3 paper registers of a single inquiry available at the headquarters of the public inquiry and in the 2 above-mentioned city halls, on the indicated days and hours;

Written observations sent by mail or handed in person to one of the commissioners of the investigation in the performance of their duties are attached to the paper register in the investigation department and made public as soon as possible. Oral observations made by the public during the inpatient stay are published in a dematerialized register by the investigating commissioner with the consent of the person present.

Article 10: Familiarization with the report and conclusions of the commission of inquiry

The report and conclusions of the commission of inquiry can be consulted at the headquarters of the public inquiry, at the city halls of Saint-Leger-sur-Dune and Saint-Lou-Gange during the days and hours of opening to the public, and on the Grand Chalon website (urban planning section) for a period for one year from the date of receipt.
